El borrador del Reglamento de Extranjería, presentado este martes por el Gobierno, abre las puertas a que los padres de menores de nacionalidad española puedan regularizar su situación es España.
El procedimiento, denominado arraigo familiar (que hasta ahora se aplicaba a otros casos), establece que el niño español tendrá que estar a cargo del padre o madre que solicite el permiso de residencia, además de vivir bajo el mismo techo.
Guillermo Morales, abogado del despacho Legalcity, valora muy positivamente esta medida pero hace un llamado a la prudencia. "Recordemos que se trata de un borrador, no de un Reglamento. Además, después tienen que venir las órdenes y hojas informativas de las oficinas de extranjería, que pueden cambiar muchas cosas", explica el jurista.
Y es que a pesar de lo espectacular de la medida, es cierto que el Reglamento no menciona nada acerca de tiempo de residencia mínimo o de la exigencia de un contrato de trabajo, requisitos que tendrán que irse aclarando si llega a ponerse en marcha este tipo de arraigo.
La medida sería beneficiosa los colectivos latinos que adquieren la nacionalidad española automáticamente al nacer aquí, como es el caso de colombianos, paraguayos o peruanos.
No cobijaría, en cambio, a los hijos de bolivianos, ecuatorianos, chilenos o mexicanos, a quienes se le impone la ciudadanía del país de origen de sus padres.
