- Entra en vigor el Decreto Real aprobado en el último Consejo de Ministros, que moderniza las condiciones laborales de los trabajadores del hogar.
- La norma actualiza la relación de caracter especial del servicio del hogar familiar, cuya texto no se modficaba desde 1985.
Hoy entra en vigor el Decreto aprobado el pasado viernes por el Consejo de Ministros y que regula la relación laboral de carácter especial del servicio del hogar familiar, cuya última modificación fue hecha hace 25 años.
Esta norma resuelve el último escollo para continuar con el proceso de plena integración de estos trabajadores en el Régimen General de la Seguridad Social, tal como se acordó entre sindicatos, Gobiernos y empresarios, y permitir así que gocen de los mismos derechos que el resto de trabajadores.
Desde el Ministerio de Trabajo han señalado que la actualización de la normativa busca “propiciar una mejora de las condiciones de trabajo de las personas trabajadoras del sector, avanzando en la dignificación del trabajo de este colectivo”.
Entre otras cosas, el texto fija que a partir del 1 de enero las trabajadoras del hogar bajo este carácter especial cobrarán en metálico como mínimo el salario mínimo interprofesional por debajo de cuya cuantía no se podrá realizar descuentos por concepto de manutención o alojamiento, lo que se llama ‘salario en especie’.
Y en caso se aplique este pago no podrá superar el 30% de las percepciones salariales (antes no había ningún monto establecido).
El empleado tendrá también derecho a dos pagas extraodinarias al año.
- Contratos escritos cuando la relación laboral sea igual o superior a cuatro semanas.
- Se podrá contratar a los trabajadores directamente, a través de los servicios públicos de empleo o de agencias de colocación.
- Se analizará en 2012 que las personas al servicio del hogar familiar puedan cobrar el paro.
